Through your booking request, you request a binding offer to conclude an accom\u00admo\u00adda\u00adtion contract with us. This among present with us on site, by mail, by e\u2011mail, by phone or via our booking request form on our website. By booking through our website you make a reser\u00adva\u00adtion and also request a binding offer to conclude an accom\u00admo\u00adda\u00adtion contract with us. When making a booking request and booking via our website, you can correct all entries on an ongoing basis. In addition, their entries are summa\u00adrized again before submit\u00adting the booking request or booking and can then be edited \/ corrected.<br><br>The confir\u00adma\u00adtion of receipt of your booking request or booking via our website will be made immedi\u00adately by automated e\u2011mail. We ask you to ensure that the email address you provide is accurate and that emails sent to it by us can be received. Please also check your \u201cSpam folder\u201d if neces\u00adsary. You will then receive, if neces\u00adsary, among those present on site and other\u00adwise by e\u2011mail a reser\u00adva\u00adtion includ\u00ading binding offer from us. You can accept it immedi\u00adately on the spot and other\u00adwise by making the deposit requested by us (currently 20% of the price). This concludes the contract. If applic\u00ada\u00adble, the contract is also already concluded by the payment trans\u00adac\u00adtion via the selected payment service provider. The time of execu\u00adtion of the payment trans\u00adac\u00adtion depends on the selected payment method (see under \u201cPayment methods\u201d).<\/li>\n\n\n\n<li>Please note that the contract can only be concluded in German, English and&nbsp;Dutch.<\/li>\n\n\n\n<li>We are not subject to any special codes of conduct.<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"4-vertragstext\">\u00a7 4 Contract text<\/h3>\n\n<p>We save the text of the contract and send you the booking data and our GTC \u2014 Accom\u00admo\u00adda\u00adtion in text form. The text of the contract is no longer acces\u00adsi\u00adble via the Inter\u00adnet. The GTC \u2014 Accom\u00admo\u00adda\u00adtion are still acces\u00adsi\u00adble via the Internet.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"5-zahlungsarten\">\u00a7 5 Payment methods<\/h3>\n\n<p>You make down payments by<\/p>\n\n<p><strong>Bank trans\u00adfer<\/strong><br>We will send you our bank details in a separate email and ask you to make a transfer;<\/p>\n\n<p><strong>PayPal<\/strong><br>To pay via PayPal, you must be regis\u00adtered there or regis\u00adter first, authen\u00adti\u00adcate yourself with your access data and confirm the payment instruc\u00adtion to us&nbsp;or<\/p>\n\n<p><strong>Immedi\u00adately by klarna<\/strong><strong><\/strong><\/p>\n\n<p>In order to be able to pay via Sofort, you must have a bank account that is activated for online banking, identify yourself accord\u00adingly and confirm the payment instruc\u00adtion to&nbsp;us.<\/p>\n\n<p><strong>Remain\u00ading payments<\/strong> can also be made on site in cash, by EC card or credit card (Visa or MasterCard).<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"6-preise\">\u00a7 6 Prices<\/h3>\n\n<p>Prices quoted are inclu\u00adsive of the applic\u00ada\u00adble sales tax. Public charges such as visitor\u2019s tax are not included in the prices and have to be paid addition\u00adally by you and your fellow travelers.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"7-unterkunftsbereitstellung-und-nutzung\">\u00a7 7 Provision and use of accommodation<\/h3>\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>The accom\u00admo\u00adda\u00adtion provided is exclu\u00adsively for lodging purposes.<\/li>\n\n\n\n<li>The subletting\/rental of the accom\u00admo\u00adda\u00adtions provided as well as their use for purposes other than accom\u00admo\u00adda\u00adtion require our prior consent (approval).<\/li>\n\n\n\n<li>Unless other\u00adwise agreed, there is no right to the provi\u00adsion of specific accommodation.<\/li>\n\n\n\n<li>Unless other\u00adwise agreed, booked accom\u00admo\u00adda\u00adtions are avail\u00adable to you from 15:00 on the day of arrival and are to be vacated by 10:00 on the day of departure.<\/li>\n\n\n\n<li>We reserve the right to reassign accom\u00admo\u00adda\u00adtions not yet claimed by 6:00 p.m. on the day of arrival. This does not apply if you have informed us in advance of a later arrival time.<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"8-haftung\">\u00a7 8 Liability<\/h3>\n\n<p>For claims based on damages caused by us, our legal repre\u00adsen\u00adta\u00adtives or vicar\u00adi\u00adous agents, we shall always be liable without limitation<\/p>\n\n<ul class=\"wp-block-list\">\n<li>in case of injury to life, body or health<\/li>\n\n\n\n<li>in the event of inten\u00adtional or grossly negli\u00adgent breach of&nbsp;duty<\/li>\n\n\n\n<li>in the case of warranty promises, if agreed, or<\/li>\n\n\n\n<li>insofar as the scope of appli\u00adca\u00adtion of the Product Liabil\u00adity Act is opened.<\/li>\n<\/ul>\n\n<p>In the event of a breach of mater\u00adial contrac\u00adtual oblig\u00ada\u00adtions, the fulfill\u00adment of which is a prereq\u00adui\u00adsite for the proper execu\u00adtion of the contract and compli\u00adance with which the contrac\u00adtual partner may regularly rely on (cardi\u00adnal oblig\u00ada\u00adtions) due to slight negli\u00adgence on our part, on the part of our legal repre\u00adsen\u00adta\u00adtives or vicar\u00adi\u00adous agents, the liabil\u00adity shall be limited to the amount of the damage foresee\u00adable at the time of the conclu\u00adsion of the contract, the occur\u00adrence of which must typically be expected.<\/p>\n\n<p>Other\u00adwise, claims for damages are excluded.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"9-hinweis-zum-nichtbestehen-eines-widerrufsrechts\">\u00a7 9 Note on the non-existence of a right of withdrawal<\/h3>\n\n<p>We point out that a right of withdrawal accord\u00ading to \u00a7 312&nbsp;g para. 2 No. 9 BGB does not&nbsp;exist.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"10-rucktritt-des-gastes-abbestellung-stornierung-und-no-show\">\u00a7 10 Withdrawal of the Guest (Cancellation and NoShow)<\/h3>\n\n<p>If you cancel the hotel accom\u00admo\u00adda\u00adtion contract or do not show up on the day of arrival by 6:00 p.m. without inform\u00ading us in advance, we are entitled to assign the booked accom\u00admo\u00adda\u00adtion to someone else. If we have agreed on a date for withdrawal free of charge, you can withdraw from the contract until then without trigger\u00ading payment or compen\u00adsa\u00adtion claims from us. The freedom from costs of their right of withdrawal expires if they do not exercise their right of withdrawal by the agreed date. From this point on, you are only entitled to a possi\u00adble legal right of withdrawal. If a right of withdrawal has not been agreed or has already expired and there is also no statu\u00adtory right of withdrawal or termi\u00adna\u00adtion and we do not agree to a cancel\u00adla\u00adtion of the contract, we shall retain the claim to the agreed remuner\u00ada\u00adtion despite your failure to use the service. However, we grant the follow\u00ading cancel\u00adla\u00adtion options subject to other individ\u00adual agreements:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>In case of cancel\u00adla\u00adtion up to the 10th day before the agreed date of arrival: cancel\u00adla\u00adtion free of charge;<\/li>\n\n\n\n<li>In case of cancel\u00adla\u00adtion up to the 4th day before the agreed day of arrival: 50% of the contrac\u00adtu\u00adally agreed price;<\/li>\n\n\n\n<li>In case of cancel\u00adla\u00adtion from the 3rd day before the agreed date of arrival: 80% of the contrac\u00adtu\u00adally agreed price.<\/li>\n<\/ul>\n\n<p>You are free to prove that the damage did not occur or did not occur in the amount claimed.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"11-streitbeilegung\">\u00a7 11 Dispute resolution<\/h3>\n\n<p>We are not oblig\u00adated or willing to partic\u00adi\u00adpate in dispute resolu\u00adtion proceed\u00adings before a consumer arbitra\u00adtion&nbsp;board.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"12-gerichtsstand\">\u00a7 12 Jurisdiction<\/h3>\n\n<p>If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclu\u00adsive place of juris\u00addic\u00adtion for all disputes arising directly or indirectly from the contrac\u00adtual relation\u00adship is the regis\u00adtered office of Ferien\u00adan\u00adlage zum Wildbach GmbH.
