sleds, trail\u00aders, handcarts, etc.) and extras (bicycle helmet, mobile phone naviga\u00adtion bag, etc.) on our website, stating the rental period you have selected together with our price infor\u00adma\u00adtion, consti\u00adtutes a binding offer to rent them to you. You can initially place them in the shopping cart without oblig\u00ada\u00adtion and correct your entries at any time before submit\u00adting your binding order (\u201crent now\u201d) by using the correc\u00adtion aids provided and explained in the order\u00ading process. The contract is concluded when you accept the offer to rent the goods contained in the shopping cart at the times speci\u00adfied there by click\u00ading the order button. Immedi\u00adately after submit\u00adting the order, you will receive another confir\u00adma\u00adtion by email. We ask you to ensure that the email address you have provided is correct and that emails sent by us can be received at this address. Please also check your \u201cspam folder\u201d if neces\u00adsary. Of course, a corre\u00adspond\u00ading contract can also be concluded in person at our premises, by post, by email or by telephone.&nbsp;<\/li>\n\n\n\n<li>Please note that the conclu\u00adsion of the contract can only be made in German, English and&nbsp;Dutch.<\/li>\n\n\n\n<li>We are not subject to any special codes of conduct.<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"4-vertragstext\"><strong>\u00a7 4 Contract text<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">We save the contract text and send you the booking data and our GTC \u2014 Rental of Leisure Equip\u00adment in text form. The contract text is no longer acces\u00adsi\u00adble via the Inter\u00adnet. The GTC \u2014 Rental of Leisure Equip\u00adment remain acces\u00adsi\u00adble via the Internet.&nbsp;<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"5-zahlungsarten\"><strong>\u00a7 5 Payment methods<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">You make the payment in advance by<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Bank trans\u00adfer<\/strong><br>We will provide you with our bank details in a separate email and ask you to trans\u00adfer the amount or<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>PayPal<\/strong><br>To be able to pay via PayPal, you must be regis\u00adtered there or regis\u00adter first, authen\u00adti\u00adcate yourself with your access data and confirm the payment instruc\u00adtion to us, whereby you will be redirected to the PayPal website during the order\u00ading process.<\/p>\n\n<p class=\"wp-block-paragraph\">Under certain circum\u00adstances, we may offer the option to pay in advance <strong>on site<\/strong>. Payment is then made in cash, by EC card or credit card (Visa or MasterCard).&nbsp;<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"6-preise-miettag-und-kaution\"><strong>\u00a7 6 Prices, rental day and deposit<\/strong><\/h3>\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>Stated prices include the applic\u00ada\u00adble sales&nbsp;tax.<\/li>\n\n\n\n<li>The rental day is the respec\u00adtive calen\u00addar&nbsp;day.<\/li>\n\n\n\n<li>Please note that a deposit (currently EUR 25) must be paid in cash per rental item upon collection.<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"7-pflichten-des-vermieters\"><strong>\u00a7 7 Duties of the landlord<\/strong><\/h3>\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>We are obliged to provide you with the rental items in proper techni\u00adcal condition.<\/li>\n\n\n\n<li>If a repair becomes neces\u00adsary during the rental period, we must carry it out or provide you with an appro\u00adpri\u00adate replace\u00adment item at the rental station. The commis\u00adsion\u00ading of other providers for repairs requires our consent, which we will not unrea\u00adson\u00adably refuse. Costs for repair orders that are carried out without our consent shall be borne by the tenant.&nbsp;<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"8-pflichten-des-mieters\"><strong>\u00a7 8 Duties of the tenant<\/strong><\/h3>\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>All users must famil\u00adiar\u00adize themselves with the opera\u00adtion of the rental item before using it and, if they do not master the rental item, must request instruc\u00adtion from&nbsp;us.<\/li>\n\n\n\n<li>All users must secure the rental items against theft and report loss, defects and damage to us immediately.<\/li>\n\n\n\n<li>You are obliged to return the rental item \u2014 apart from soiling and wear and tear within the scope of normal use \u2014 in the same condi\u00adtion as you received it from&nbsp;us.<\/li>\n\n\n\n<li>All users must treat the rental item with care and consideration.<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"9-haftung\"><strong>\u00a7 9 Liability<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">For claims due to damages caused by us, our legal repre\u00adsen\u00adta\u00adtives or vicar\u00adi\u00adous agents, we are always liable without limitation<\/p>\n\n<ul class=\"wp-block-list\">\n<li>in the event of injury to life, body or health<\/li>\n\n\n\n<li>in the event of inten\u00adtional or grossly negli\u00adgent breach of&nbsp;duty<\/li>\n\n\n\n<li>in the event of guaran\u00adtee promises, insofar as agreed, or<\/li>\n\n\n\n<li>insofar as the scope of appli\u00adca\u00adtion of the Product Liabil\u00adity Act is opened.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In the event of a breach of essen\u00adtial contrac\u00adtual oblig\u00ada\u00adtions, the fulfill\u00adment of which makes the proper execu\u00adtion of the contract possi\u00adble in the first place and on whose compli\u00adance the contrac\u00adtual partner may regularly rely (cardi\u00adnal oblig\u00ada\u00adtions) through slight negli\u00adgence on our part, our legal repre\u00adsen\u00adta\u00adtives or vicar\u00adi\u00adous agents, liabil\u00adity is limited in amount to the damage foresee\u00adable at the time of conclu\u00adsion of the contract, the occur\u00adrence of which must typically be expected.<\/p>\n\n<p class=\"wp-block-paragraph\">Other\u00adwise, claims for damages are excluded.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"10-hinweis-zum-nichtbestehen-eines-widerrufsrechts\"><strong>\u00a7 10 Note on the non-existence of a right of withdrawal<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">We point out that there is no right of withdrawal in accor\u00addance with \u00a7 312&nbsp;g para. 2 no. 9&nbsp;BGB.&nbsp;<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"11-streitbeilegung\"><strong>\u00a7 11 Dispute resolution<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">We are not obliged and not willing to partic\u00adi\u00adpate in a dispute resolu\u00adtion proce\u00addure before a consumer arbitra\u00adtion&nbsp;board.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"12-gerichtsstand\"><strong>\u00a7 12 Jurisdiction<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclu\u00adsive place of juris\u00addic\u00adtion for all disputes arising directly or indirectly from the contrac\u00adtual relation\u00adship is the regis\u00adtered office of Ferien\u00adan\u00adlage zum Wildbach GmbH.
